1.                Promotion Overview

1.1              DMMC Limited (8484276) trading as Cutlers Real Estate (“Cutlers”) Vendor Giveaway Promotion (“Promotion”) offers Eligible Vendors the chance to win a: major cash prize of NZD $40,000 and runner-up cash prize of NZD $10,000. The Promotion is conducted as a sales promotion scheme to promote sale of Cutlers goods/services.

2.                Promotional Period

2.1              The Promotion commences at 12:00 am NZT on 1 October 2025 and closes at 11:59 pm NZT on 31 March 2026 (“Promotional Period”).  Winners will be drawn on 30 April 2026 in accordance with clause 6.

3.                Eligibilty

3.1              Entry is open to vendors who:

(a)               Enter into Cutlers’ standard exclusive agency agreement for the entire listing period to sell a residential or commercial property through Cutlers;

(b)               Purchase the Cutlers Platinum Marketing Package for the property;

(c)               Do not appoint or advertise with any other real estate agent for the property during the listing period;

(d)               Signed the Vendor Acknowledgement in these Terms and Conditions; and

(e)               Achieve an unconditional contract for sale (residential or commercial) by 17 April 2026. Settlement may occur after this date, provided the contract is unconditional by 17 April 2026.

("Eligible Vendors")

3.2              The following persons are ineligible to enter: Directors, employees, contractors, and immediate family members (spouse, de facto partner, parent, child, or sibling living at the same address) of Cutlers or any related entity.

3.3              One entry per property sold.  If a vendor sells multiple qualifying properties, each property constitutes a separate entry.

4.                Entry Mechanics

Eligible Vendors are automatically entered into the Promotion once the property sale becomes unconditional  by 17 April 2026 and the vendor has paid for the Cutlers Platinum Marketing Package in full and signed the Vendor Consent and Acknowledgement in Terms and Conditions.

4.1              No additional purchase or fee (beyond standard agency commission and Platinum Marketing Package costs) is required for entry.

5.                Prizes

5.1              Major Prize of NZD $40,000 cash.

5.2           Runner-Up Prize of NZD $10,000 cash

5.3              Prizes will be paid by electronic transfer to the winner’s nominated New Zealand bank account within 10 business days of winner verification.

5.4              Prizes are not transferable, exchangeable, or redeemable for other goods or services.

6.                Prize Draw and Winner Notification

6.1              The prize draw will take place at approximately 11:00 am on 30 April 2026.  The draw will be conducted live and streamed via the official Cutlers Real Estate Facebook Page.

6.2              The winners will be chosen at random using a verifiable random-selection method, supervised by an independent person.  The first winner drawn will win the runner-up prize of NZD $10,000 cash and the second winner drawn will win the major prize of NZD $40,000 cash.

6.3              Winners will be contacted by phone and email within three (3) business days of the draw. Winners may be announced on Cutlers’ website and social media channels, subject to consent and privacy obligations.  If a winner cannot be contacted within fourteen (14) business days, Cutlers may conduct a redraw.

6.4              In the event of any dispute regarding the conduct of the draw or the selection of winners, Cutlers will make reasonable efforts to resolve the dispute in good faith. If the dispute cannot be resolved internally, it may be referred to an independent third party for review.

7.                Verification and Compliance

7.1              Cutlers may request proof of identity, property ownership, and compliance with these Terms and Conditions; including proof of purchase of Cutlers Platinum Marketing Package.  Failure to provide satisfactory evidence may result in disqualification.

7.2              Cutlers reserves the right to disqualify any entry that breaches the exclusive-listing requirement or any other term of these Terms and Conditions.

8.                Publicity

8.1              By signing these Terms and Conditions, participants agree and consent to their name potentially being announced at the draw if there are the winner.

8.2              By accepting a prize, winners agree (without further compensation) to participate in reasonable promotional activities, including the use of their first name, suburb, and property description, unless they expressly decline.

9.                General

9.1              Cutlers may amend, suspend, or cancel the Promotion where necessary due to events beyond its reasonable control, subject to any applicable regulatory approval if required, affected vendors will be notified as soon as practicable using the contact details provided in their agency agreement.

9.2              All decisions of Cutlers regarding the Promotion are final, subject to any review rights under consumer or gambling legislation.

9.3              Any tax liability arising from receipt of a prize is the responsibility of the winner. Cutlers recommends that winners seek independent tax advice regarding the tax treatment of their prize.

9.4              Cutlers reserve the right to verify the validity of entries, disqualify any entrant who tampers with the process or acts fraudulently.

9.5              Cutlers accepts no responsibility for late, lost, or misdirected entries or vendor circumstances that prevent entry.  To the extent permitted by law, Cutlers is no liable for any loss, damage or injury suffered in relation to this Promotion.

10.              Legal and Regulatory Compliance

10.1            The Promotion is a “sales promotion scheme” under the Gambling Act 2003  and is designed to promote the services of Cutlers Real Estate and is not a lottery, raffle, or gambling product.  Cutlers Real Estate does not derive any profit from the Promotion itself, and the Promotion is conducted in accordance with the Gambling Act 2003.

10.2            The records of this Promotion and participant data will be securely kept for at least three years as required by the relevant legislation.  These records may be made available to regulatory authorities for audit or inspection if required. 

10.3            Participant data will be collected, stored, and used in accordance with the Privacy Act 2020 and Cutlers’ privacy policy.  Express consent will be obtained for any publicity use of personal information outside what is agreed under these Terms and Conditions. 10.5            These Terms and Conditions are governed by New Zealand law. Any disputes will be resolved in accordance with New Zealand law and the dispute resolution process set out by Cutlers.

10.6            Nothing in these Terms and Conditions are intended to have the effect of contracting out of the Consumer Guarantees Act 1993 except to the extent permitted by that Act, and all provisions shall be read as modified to the extent necessary to give effect to that intention.

10.7            Cutlers will ensure appropriate internal controls over the draw process and funds transfer.

10.8            Any rebates, discounts, or commissions that Cutlers may receive in connection with the Platinum Marketing Package or any related services will be disclosed to vendors in the agency agreement, in accordance with section 128 of the Real Estate Agents Act 2008.  If no such rebates, discounts, or commissions apply, this will also be confirmed in the agency agreement.

10.10          Entry into this Promotion requires the vendor to enter into a standard exclusive agency agreement with Cutlers.  All agency agreements must comply with the Real Estate Agents Act 2008 and the Real Estate Agents (Licensing) Regulations 2009

10.11          Cutlers Real Estate is committed to treating all vendors fairly and impartially.  Any actual or potential conflicts of interest arising in connection with this Promotion will be disclosed to vendors in accordance with the Real Estate Agents Act 2008 and the Real Estate Agents Authority Code of Professional Conduct and Client Care.

VENDOR ACKNOWLEDGEMENT

I, the undersigned vendor, confirm that I have read, understood, and agree to be bound by these Terms and Conditions of the Cutlers Real Estate Limited Vendor Giveaway Promotion as set out above. In particular, I acknowledge and agree to the following:

I have entered into a standard exclusive agency agreement with Cutlers for the sale of my property.

I have purchased and will utilise the Cutlers Platinum Marketing Package for my property.
